A project recently added to your Website by a group named OpenDDR-org infringes WURFL.xml as substantial elements of it are copied from WURLF.xml. OpenDDR-org admitted to the copying in a post on the internet that has subsequently been removed. We have identified two files below that we have a good faith believe are infringing upon my client's copyrighted work, and we are still reviewing the other files contained within the OpenDDR-org project and reserve the right to request further takedown if we find that those works also infringe my client's intellectual property rights. Your website proposes a preferred format for DMCA takedown requests and the numbered responses below correspond to your requested format.
1. My client's work that was infringed - the WURFL.xml - can be found at the following URL: <http://www.ScientiaMobile.com/communitywurfl/wurfl.zip>. You also ask that we identify the work infringing upon the copyright in my client's work. We have done so in item 2 below.

I am the original author of unofficial RTMPE Handshake 10 patch for utility
rtmpdump. This patch became by mistake publicly accessed on various sites. Even
more - this patch was not dedicated to be stored at open-source sites, but
person with nickname 'svnpenn' uploaded it and now he refuses to delete it. The
main problem of this patch is that it contains some binary data from Adobe Flash
Player executable and it may infringe copyright under some circumstances. I do
not want to be responsible for people who may use proof of concept code in wrong
purposes.

Much of the code is fine to be placed there (we allow it for portions of our libraries that we make available on our site for free), but certain portions are not. For example, TransformManager is a $299 product that we sell here:

The code in question references RAD Game Tools’ copyrighted code (copyright 1997-2012) for using our
Bink video codec SDK.
A bit of background: Cyan Worlds release their Myst engine as open source in 2011. Cyan Worlds had
been a Bink licensee for the original, non-open source Myst, however, they erred when they released, and
accidentally included sample code for using Bink, which was copied almost verbatim from the Bink SDK
help file. Cyan World’s license specifically prohibited them from releasing this code. When we at RAD
discovered this breach in December, 2012, we contacted Cyan, who in turn reached out to their open source
community and asked everyone to remove the infringing material. Almost everyone in the community did
their best to honor RAD’s copyrights, but in monitoring the conversation at
http://forums.openuru.org/viewtopic.php?f=91&t=848&start=50
I discovered that one user in particular has posted the material at GitHub, and also noted on his page there:
“plLayerBink
You remove it, i add it.”
Therefore we at RAD Game Tools, Inc., owner of the copyrighted software in question, ask that you
remove the code. I have a good faith belief that use of the copyrighted materials described above on the
infringing web pages is not authorized by the copyright owner, or its agent, or the law.
